Delaware Mall Assault Shows Dangers Shoppers Face, Raises Questions about Victims’ Rights in Face of Negligent Mall Security

Mall

A severe and brutal attack on two teens at a mall in Delaware provides a shocking example of the dangers that American shoppers may face when they visit retail shopping centers and raises questions about what victims can do if they are assaulted on business properties. According to the Delaware State Police, the vicious attack took place on February 24 at around 6:07 p.m. at the Christiana Mall in Newark. Delaware State Troopers responded to a call for assistance due to several teenagers fighting in the mall. When police arrived at the shopping center, they found out that prior to the fight, two of the individuals involved, a 14-year-old and a 16-year-old, had been walking in the mall when a group of unknown teens surrounded them and an altercation began. Delaware State Police report that, “An argument ensued between the teens, during which one of the suspects hit the 16-year-old victim and then pushed him to the ground as he tried to leave. The suspects proceeded to kick and punch the 16-year-old victim, which led to the 14-year-old teen running over to help his friend. The suspects pushed the 14-year-old to the ground next to the 16-year-old and continued kicking and punching both victims before fleeing on foot towards the parking lot as mall security approached.”

As a result of the severe beating, the 14-year-old teenager was taken for emergency medical treatment for serious injuries.  The 16-year-old teen was injured, but his injuries were classified as “non-life-threatening.” Ultimately, due to his role in the fight, a 17-year-old New Castle, Delaware teen was arrested and charged with felony assault. Three remaining teens who were involved in the fight are still considered suspects, and the investigation into the incident is still ongoing.
